Terms of Service

These Terms of Service ("Terms") govern your use of BranchCAD (the "Service"), operated by Manaia Data Analytics Limited. By using the Service you agree to these Terms. This is a placeholder pending legal review.

§1 Your account

You are responsible for keeping your account credentials secure and for activity under your account. You must be able to form a binding contract to use the Service.

§2 Plans and payment

The Service is free to start, with paid plans for additional features and seats. Paid plans are billed in advance on a monthly or annual basis through our payment processor. Prices are shown at branchcad.com/#pricing. Taxes may apply depending on your location.

§3 Your content

You retain all rights to the drawings and content you create. You grant us the limited licence needed to host, process, and display that content so we can provide the Service (including version history and collaboration). You are responsible for having the rights to any content you upload.

§4 Acceptable use

You agree to use the Service in line with our Acceptable Use Policy. We may suspend or terminate accounts that violate it.

§5 Availability

We work to keep the Service available and reliable but provide it "as is" without warranties. We may modify or discontinue features with reasonable notice.

§6 Limitation of liability

To the extent permitted by law, our liability arising from the Service is limited, and we are not liable for indirect or consequential loss. Nothing limits rights that cannot be excluded under applicable consumer law (including the New Zealand Consumer Guarantees Act, where it applies).

§7 Termination

You may stop using the Service at any time. We may suspend or end access for breach of these Terms. On termination you can export your content subject to your plan.

§8 Governing law and contact
